The concern is not that “The View” expresses opinions. It can. Opinion programming is a longstanding part of American public discourse. The concern is that opinion-driven political talk shows fall under a different regulatory structure than traditional news. Congress created this law, and it should be applied fairly.
The hosts of “The View” routinely engage in political commentary, advocate for particular policy positions, and express opinions about political candidates and public officials. And these views all benefit one political ideology and one political party. It is clearly not “news.”
